1. Agreement

These terms are an agreement between you and HostKarle (“we”, “us”), of Jateswar, Alipurduar, West Bengal 735216, India. They apply to our website hostkarle.in, the client area at my.hostkarle.in and every service you buy from us — shared hosting, domains, email and anything else we sell.

By placing an order or using a service you accept these terms, our privacy policy and our refund policy. If you do not agree, please do not use our services.

2. Your account

• You must be at least 18, or have a parent or guardian's permission, and give us true and current contact details.
• You are responsible for everything that happens under your account and for keeping your passwords safe.
• We may ask for proof of identity or payment to prevent fraud. Orders that fail these checks can be cancelled.

3. Backups are your responsibility

• Your control panel includes tools to create and download full backups. Take them regularly and keep copies off our servers — on your own computer or another storage service.
• Any backups we make on our side are a courtesy for our own disaster recovery. They are not part of what you pay for, they may be incomplete, out of date or unavailable, and we do not guarantee that any backup exists or can be restored.
• If we do restore data for you, we do so on a best-effort basis with no promise about the result.
• When an account is cancelled, suspended for too long, terminated or refunded, its data is deleted and cannot be recovered.

4. Payment, renewals and suspension

• Prices are in Indian rupees. GST is added where applicable.
• Services renew automatically for the same billing period. We send the renewal invoice ahead of the due date; it is your job to pay it on time.
• If an invoice is unpaid after its due date, the service may be suspended, and later terminated with all its data deleted.
• Domains that are not renewed in time expire under the registry's rules and may cost extra to recover, or be lost.
• Refunds follow our refund policy. Raising a chargeback instead of contacting us may lead to the account being suspended.

5. Acceptable use

Shared hosting means many customers share one server, so some things are not allowed. You must not host, send or link to:

• Anything illegal in India, including pirated software, films or music and content that infringes someone's copyright or trademark.
• Adult or pornographic content, gambling or casino sites.
• Phishing pages, malware, hacking tools, or scam and fraud sites.
• Unsolicited bulk email (spam), or mailing lists people did not sign up for.
• Cryptocurrency mining, proxies, torrent or file-sharing services, or scripts that attack other systems.
• Anything that uses so much CPU, memory, disk or traffic that it harms other customers.

We may suspend or remove content that breaks these rules, with or without notice, and without a refund.

6. Resources and fair use

Each plan has limits on storage, CPU, memory, processes, email sending and similar resources. Where a plan is called “unlimited”, it is unlimited for normal websites and still subject to fair use. If your site outgrows a plan, we will ask you to upgrade. Hosting is for websites and email — not for storing backups or files unrelated to your site.

7. Uptime and maintenance

We work to keep services online and aim for 99.9% uptime, but we cannot promise the service will never be interrupted. We may carry out maintenance, and we will announce planned work when we reasonably can. Service credits or refunds for outages are covered only by our refund policy.

8. Domain names

Domains are registered through our registrar partner and follow the rules of each registry, including ICANN rules for .com and NIXI rules for .in. You must give correct contact details and complete any email or identity verification the registry asks for, or the domain may be suspended. You are the registrant of the domain you pay for.

9. Limitation of liability

To the extent the law allows, our services are provided “as is”. We are not liable for any indirect or consequential loss — including lost profits, revenue, data, customers or business — arising from your use of our services or from any downtime or data loss.

Our total liability for any claim is limited to the amount you paid us for the affected service in the 3 months before the claim arose.

You agree to cover any loss we suffer because of content you host or the way you use our services.

10. Cancellation and termination

You can cancel any service from the client area at any time. We may suspend or terminate a service if you break these terms, do not pay, or if the law requires it. On termination your data is deleted — see section 3.

11. Governing law

These terms are governed by the laws of India. Any dispute will be handled by the courts at Alipurduar, West Bengal.

12. Changes and contact
